NanaCast Terms of Use
This is a translation. If it differs from the Korean original (TERMS_OF_USE.txt), the Korean original prevails.
Article 1 (Purpose)
These Terms set out the conditions for using the NanaCast viewer, the NanaCast exporter and runtime packages, and the related web services (nanacast.app, auth.nanacast.app; together, the "Software") provided by Gyunana (the "Operator"), and the rights and obligations of the Operator and users.
Article 2 (Definitions)
1."Viewer" means the Windows program that displays avatars and provides tracking, staging and output.
2."Exporter" means the Unity package that exports avatars, stages, props and motions from a Unity project into NanaCast files.
3."NanaCast files" means .ncavatar, .ncstage, .ncprop and .ncmotion files made with the Exporter.
4."User content" means any material a user loads into or exports with the Software, such as avatars, outfits, stages, props, motions, images and videos.
Article 3 (Effect and changes)
1.By purchasing, downloading, installing or running the Software, you agree to these Terms.
2.The Operator may change these Terms within the limits of applicable law. Changes are announced on nanacast.app 7 days before they take effect, or 30 days before for changes unfavourable to users.
3.If you do not agree to the changed Terms, you may stop using the Software. Continuing to use it after the effective date means you accept the changed Terms.
Article 4 (License)
1.The Operator grants you a non-exclusive, non-transferable right to use the Software in accordance with these Terms.
2.The Viewer is sold on its BOOTH sales page. A user who has bought the Viewer (the "Purchaser") may install and use it on any number of PCs that the Purchaser personally uses. It may not be shared with or used by anyone else.
3.The Exporter, the runtime package and the web services are provided free of charge.
4.The Purchaser may use the Viewer for their own streaming, recording and video production, including commercial activity (donations, ad revenue, commissioned streams, selling videos, etc.). Companies and organizations (businesses, agencies, etc.) must contact the Operator before using it for their work.
5.The Purchaser receives the updates offered on the sales page at no extra cost. Features or versions the Operator may sell as separate products in the future may not be included.
6.Copyright and other intellectual property rights in the Software belong to the Operator. These Terms do not transfer ownership of the Software to you.
7.Open-source components included in the Software are governed by their own licenses (see THIRD_PARTY_NOTICES.txt). Where such a license grants broader rights than these Terms, that license prevails for that component.
Article 4-2 (Purchase and refunds)
1.The price and payment of the Viewer follow its BOOTH sales page and BOOTH's terms of service.
2.The Viewer is a downloadable digital product, so it is not refunded after purchase except where applicable law grants a right of withdrawal or a refund. Please check the requirements, notes and introduction video on the sales page before buying.
3.If the Viewer does not run or has another problem, please first contact X (Twitter) @Gyunana_VRC. The Operator will help find the cause and fix it.
Article 5 (Prohibited acts)
You must not:
1.copy the Software and distribute, sell, lend, transfer or republish it to others (unless the Operator allows it);
2.reverse engineer, decompile, disassemble, modify or alter the Software beyond what applicable law permits;
3.circumvent or disable any usage restriction or license check;
4.extract original assets (models, textures, stages, etc.) from NanaCast files, or use or distribute extracted assets;
5.share or distribute NanaCast files or user content made by others without the right holder's permission;
6.send excessive requests to, disrupt, or attempt unauthorised access to the Operator's servers (such as auth.nanacast.app);
7.use the Software for purposes contrary to law or public order;
8.infringe the rights or reputation of the Operator or third parties.
Article 6 (User content and third-party rights)
1.Rights in user content belong to their holders. The Operator claims no rights in user content.
2.Whether avatars, outfits, stages and the like may be used outside VRChat, or for streaming and commercial activity, depends on each right holder's terms. You are responsible for checking and following them.
3.NanaCast files contain the original models and assets. You must not give NanaCast files you made to others without the right holder's permission.
4.You are responsible for resolving disputes about user content. The Operator is not liable unless it acted intentionally or with gross negligence.
Article 7 (External services; unofficial status)
1.The Software can be used together with external services and programs such as VRChat, CHZZK, OBS Studio and iFacialMocap. Their use is governed by their own terms and policies.
2.The Software is unofficial. It is not made or endorsed by, and not affiliated with, VRChat Inc., NAVER Corp. or other external service providers. VRChat, CHZZK (치지직) and other names are trademarks of their owners.
3.Some features may stop working because of changes to, or discontinuation of, external services.
4.You are responsible for checking whether using the Software alongside other programs (such as games) complies with their terms and anti-cheat policies.
Article 8 (Changes and discontinuation)
1.The Operator may add or change features, or stop providing part or all of the Software for operational or technical reasons.
2.The Operator gives no compensation for changes to, or discontinuation of, features provided free of charge.
Article 9 (Disclaimer of warranty)
1.The Software (in particular, beta versions) is under development and provided "as is", without any warranty that it is error-free or fit for a particular purpose.
2.Keep your own backups of important data (Unity projects, settings, recordings, etc.).
Article 10 (Limitation of liability)
1.Unless it acted intentionally or with gross negligence, the Operator is not liable for damage arising from use of the Software (including data loss, broadcast mishaps or sanctions on external service accounts).
2.Where the Operator is liable, to the extent permitted by law its liability is limited to the amount you actually paid for the Software; for free use, to the minimum required by law.
3.This Article does not limit rights given to you by applicable law, including consumer protection law.
Article 11 (Termination)
1.If you breach these Terms, the Operator may terminate your license.
2.On termination you must stop using the Software and delete your copies.
Article 12 (Governing law and jurisdiction)
1.These Terms are governed by the laws of the Republic of Korea.
2.Disputes relating to the Software are resolved by the court having jurisdiction under the Korean Civil Procedure Act.
